The license is related to antiquarians of mobile monuments

Γενικά Δικαιολογητικά

  • A list with current personnel, if any.
  • A plan diagram of the area with storehouses included, on a scale 1/50 in two copies, referring to areas’ dimensions and clarifying their intended use, certified by a Graduate Engineer declaring that all requirements stipulated in the decision YPPO/DOEPY/TOPYNS/34668, are met. More specifically, the technical requirements include the following: a)the area and the storehouse of the antique store have to be seated in cities where Services (Hellenic Ministry of Culture and Tourism) competent for the protection of culture heritage are established. b) the area and the storehouses have total area at least 50 cm and minimal internal free height at least 2.50 m. c) they have suitable system of safety (alarm etc.) d) they have installations of firefighting and fire safety according to reported below (No 9) study, and e) the access in individuals with infirmity is easily processed
  • A two year of professional experience. This experience is proved by a relative certification of the employer accompanied with a certification of the actuarial institution for the above mentioned period
  • Applicant's solemn statement that he/she has not been irrevocably charged for any offence or infringement of law regarding the protection of cultural property or for bribery, theft, swindling, acceptance of crime products
  • Applicant's solemn statement that the antique store and its storehouses thereof, have to be equipped with proper and adequate lighting and air-condition means so as to meet the requirements and regulation of good maintenance and security of mobile monuments and that the show cases and the lockers of the antique store where mobile monuments are exhibited, have to fulfill all good maintenance and security requirements, especially bearing protective glass, they must be locked with secure lockers and be equipped with proper lighting system and humidity level controller
  • Applicant’s solemn statement (in case of Legal Person, to be filed by its administrators and its administration bodies’ as well) declaring that he/she has not been recognized as collector of monuments and does not (or did not) exercise an occupation regarding the protection of monuments
  • Full copy of his/her Criminal Record (automatically and compulsorily sought by the Authority, if issued by national authorities).
    In case of no existence of a copy of criminal record, it is required the provision of an equivalent document that has been published by the responsible juridicial or administrative body of the country of origin of the applicant, by which it will results that the requirements are satisfied. If the country of origin does not grant such a document it is possible for this document to be replaced by a statutory certification, or for the member states where the statutory statement does not exist , by a solemn statement which is submitted by the interested person to the responsible juridicial or administrative body/authority or case by case to a notary staying in the country of his/her origin, who grants a certification for provision of statutory statement or official statement. The documents which are published according to the above, are not possible to be submitted after the byway of three months from their date of publication.
  • Ownership or assignment title of the property or the leasing contract of the building where the antique store will be established.
  • Study of firefighting approved by the Fire Brigade
  • When the establishment is housed in block of flats: its articles of association, by which it will be obvious that it is permitted for a store to operate there.

1)Two-year (2) professional experience proven by employer’s certificate, accompanied by a certificate by the competent insurance institute for the aforementioned period of time. 2)The areas and storehouses of the antique shops, as long as no stricter requirements are imposed by other provisions,: a) they have to be of at least 50 sq.m., b) their internal height has to be at least 2.5m c) they have to be equipped with a proper security system (alarm etc), d) they have to be equipped with fire extinguishing and fire protection system, according to an authorized study by the Fire Brigade Authority. 3)The show cases and the lockers of antique stores where mobile monuments are exhibited, have to fulfill all good maintenance and security requirements, especially bearing protective glass, they must be locked with secure lockers and be equipped with proper lighting system and humidity level controller. All antique stores , and the storehouses thereof, have to a) be perfectly clean, b) allow proper cleaning and decontamination thereof, c) be equipped with proper and adequate lighting and air-condition means so as to meet the requirements and regulation of good maintenance and security of mobile monuments. 4)All antique stores , and the storehouses thereof, may not be established in an underground area. 5) Use and placement of flammable material is prohibited in areas where antique stores or new mobile monuments stores are established, as well as storehouse thereof. 6) Antique stores have to be accessible by disabled persons.

 The application is submitted to the Ephorate of Private Archaeological Collection of the Hellenic Ministry of Culture and Tourism, which after its autopsy will propose relatively in the Directorate of Museums, Exhibitions and Educational Progarms, which after a control of the relative issue sends its proposal and the application to the Central Archaeological Council for its consultation, as it is set by the law, and afterwards the publication of Ministerial Decision.

Notes and clarifications
1) a) If the respective permit is awarded, a special sign has to be placed at the entrance of the antique stores or new mobile monuments stores, which will be provided by the respective service.
b) In the event of relocation of the antique store  or in the event of a substantial intervention, a previous application has to be submitted for approval, according to the decision YPPO/DOEPY/TOPYNS/34668. A relocation or substantial intervention in the facility housing the antique store or the new mobile monuments store, without previous notification, will automatically mean the revocation of the permit.
c) Antiquarians have to promptly inform the competent authority on the exact place of keeping the monuments, any intended transfer as well as any event that may jeopardize the item or even cause their loss.
d)  Antiquarians have to abide by the recommendations of the authority, facilitate the direct and easy access of competent services’ employees (Hellenic Ministry of Culture and Tourism) in their facilities and facilitate photo-shooting and study of the monuments by specialized experts authorized by the authority.
e) The facilities housing the antique stores have to abide with all good maintenance and safety regulations for mobile monuments. In the event that one or more monuments are under direct danger of damage, loss or destruction by any cause, the authority has to order any necessary measures in order to prevent such danger. In the event that the antiquarian or the trader of new mobile monuments neglects or delays to proceed to such measures, the Authority may take all necessary or decide the transfer of the mobile monument in a public museum or another appropriate area up to final elimination of the danger, at the cost of the antiquarian or the trader of new mobile monuments. Such expenses will be collected according to the provisions of the Code for the Collection of Public Revenues (KEDE).
f) The antiquarian has to keep a book, certified by the Authority, which would include all mobile monuments just after their acceptance in his/her store. Their recording will include the monument’s description, photo and origination, the particulars of the previous holder or owner of the monument as well as the person to whom it is transferred, particulars of antiquity possession permit, its price and transfer date. Such particulars shall be communicated to the Service, within ten (10) days at the most.
g) All legal supporting documents issued by antiquarians  in case of ownership or possession transfer, as per par.5, article 32, Law 3028/2002, have to include: A) registration number of the monument, B) brief description of the monument, C) buyer’s particulars, D) monument’s sale price, E) reference that the monuments may not be exported abroad without previous permission or that it is possible to export them according to the provisions of art.34, Law 3028/2002.
h) In case of transfer of possession of an ancient mobile monument dated up to 1453, the antiquarian has to inform the buyer in writing that he/she has to promptly declare the purchase of such monument to a competent authority and ask for the respective possession permit, according to the provisions of article 23, Law 3028/2002. In case of transfer of possession of a monument posterior to 1453, dated up to 1830, which is an excavation or other archeological research finding or that has been detached by a stable monument, as well religious icon paintings and liturgy items of the same period or characterized as monuments of similar mobile cultural items, the antiquarian or the trader of new mobile items has to inform in writing the buyer that he/she is liable to timely submit a statement to the competent authority describing how he/she acquired such mobile monuments as well as declaring the previous holder’s particulars, according to the provisions of article 24, Law 3028/2002.
2) There are no jointly competent Authorities.
