  • • Order contract by the owner/possessor of the mobile monuments under auction. The Contract has to include, at least, the following: A) implementation provision of the Greek Legislation, with special reference to the provisions of par. 5 and 6, article 28, Law 3028/2002, B) Analytical particulars of the agency to perform the auction and of the principal-seller, including their address, C) Precise description of the items under auction, D) Possible sale price as defined by the principal-seller, E) the place and time of conduct of auction F) Means and time of delivery of the monument from and to the place where the auction is about to be held, G) Method of payment, upon award to the highest bidder (Ministerial Decision YPPO/DOEPY/TOPYNS/34674 article 6)
  • • Particulars of the agency’s principal to perform the auction.
  • • Photographic list of mobile monuments
  • • Possession/Ownership permit of mobile monuments

Προϋποθέσεις

1) The auction is held at their registered office. Otherwise, an autopsy will be held in the area where the auction is about to take place by the competent Authority. 2) The items under auction belong either to them either they have been delivered to them upon auction order by a third party. 3) The auctions can be conducted by antiquarians, traders of modern monuments, legal or natural persons. In the application must be clearly reported the person that conducts the auction (analytical reference to his/her name, his/her profession, if he/she is an antiquarian, trader of modern monuments, legal or natural person). There must also be reported: the particulars of the auction's conduct, the date and place of the auction's conduct as well as the place of keep of the mobile monuments. For auctions conducted by natural or legal persons a special permit provided by the authority (personalized-non transferrable). It is awarded upon the interested party’s application to the competent authority as long as: A) they have the respective professional experience proven by at least two-year activity in the field of art auction, B) they have experienced and skilled personnel, C) they abide by the code of conduct imposed by current legislation, as well as by all international practices concerning the performance of auctions, D) they have proper store and storehouse facilities in cities where services of the Hellenic Ministry of Culture and Tourism are seated, competent for the protection of mobile monuments under auction, E) they are not employees of the Hellenic Ministry of Culture and Tourism or members of recognized museums belonging in Public Sector or broader Public Sector (they do not have the impendiments of the par.12 of the article 32 of the law 3028/2002), they have not been recognized as monument collectors, they are not occupied or have been occupied in the field of monuments’ protection, F) they provide all guarantees for the fulfillment of auctioneer’s requirements (Decision YPPO/DOEPY/TOPYNS/34674 article 9). ( they are not eligible if they have been irrevocably convicted for offence, or law infringement regarding protection of cultural heritage or forgery, bribery, theft, swindling or acceptance of crime products. The prevention remains for the time period the conviction is pending for one of the aforementioned offences, the application may be rejected even though suspension was ordered for the execution of the penalty for one of the aforementioned offences or in the event that the prosecution has permanently ceased due to prescription) If the applicant is a legal person, the prevention has not to be related with the administrators or administrative bodies. (For Legal Persons): at least one competent person has to be assigned for the performance of the auction, who has to be meet the following skills: a) Higher Education Diploma or Degree by a National Institute or by equal institutes abroad, preferably in the field of History and Archeology or Mass Media and Culture or b) at least a two-year experience in an enterprise activated in the field of organization of cultural items auctions (Decision YPPO/DOEPY/TOPYNS/34674 article 9).

Διαδικασία

Submission of application for the performance of auction at least two months before to the competent authority.

step 1: Submission of a precise list with all items under auction

step 4: Scientific examination, photo-shooting and recording of the mobile monument by a competent employee specialized in the item for sale, and next drafting of a report – by the said employee – submitted to the competent authority of the Hellenic Ministry of Culture and Tourism.

step 3: Autopsy of the area where the auction is about to be held (Safety and good maintenance rules).

step 2: Inspection by the competent authority of any typical and substantial requirements, as specified in the “Auction by Natural and Legal Persons”.

Provision of a permit and communication hereof to the Department of Non Public Archeological Museums and Unions, Antique stores (Directorate of Museums, Exhibitions and Educational Programs, General Directorate of Antiquities and Cultural Heritage, Hellenic Ministry of Culture and Tourism).
