Κόστος: For the Founder-Owner Provision of a permit to natural persons or Private Law Legal Persons requires payment of 440.20 euros to any Public Fund and submission of the receipt (duplicate receipt). Transfer of permit requires payment of 440.20 euros. School Relocation (change of building) requires payment of 146.73 euros. More information is included in P.D. 457/83. All issues regarding payment of the fees are regulated by the provisions of the Joint Ministerial Decision no. ΥΠΠΟ/ΚΑΤΕΧΝ/Δ/7388/7-2-1994 on “Determination of fees for Establishment of Art Education Higher Schools and Private Music Institutes» (Government Gazette 123/B/1994). No fees are paid in case the Private or Public Law Legal Person is tax exempted
Nομικό Πλαίσιο: Joint Ministerial Decision (GG 2665/B/9-11-2011) Presidential Decree 457/1983 (Government Gazette 174/A/1983) Establishment and operation of amateur dance schools Law 1348/1983 (G.G. 47/a/1983) “Dissolution of the Public Law Legal Person under the title “Arma Thespidos” and other provisions”, article 15, par. 1: “Validity of articles 6, 7, 8, 10 and 17 to 22”, Law 1158/19818 “On the Administration of Higher Artistic Education Schools etc” also applies to amateur Dance Schools”. [The competency for the provision of establishment and operation permits to Amateur Dance Schools (formerly belonging to the Hellenic Ministry of Culture and Tourism), has been transferred (as per the provisions of article 26, par.8, Law 2819/2000 – G.G. 84/A/2000 and article 1, Presidential Decree 347/1986 – Government Gazette 154/A/1986) to Prefectural Administration offices.]
THIS PERMIT REFERS TO THE AMATEUR DANCE SCHOOLS
FOR THE FOUNDER – OWNER Requirements for the Founder – Owner 1. Greek citizens or Nationals-members of the European Union 2. To have attained their 21st year of age 3. To have completed their military obligations or to have been legally exempted therefrom 4. Not to have been characterized as draft evaders or finally convicted for desertion. 5. Not to have been convicted of any offence that may prohibit appointment in the public sector. 6. To enjoy all their civil rights and not to have been declared bankrupt or prohibited. 7. To hold a diploma or degree by a recognized professional Dance School a) in Greece or by a foreign recognized higher or highest Dance School b) or 15-year artistic career as a dancer or choreographer of classical and modern repertoire, c) or 15-year of successful teaching experience to a recognized by the State Dance School. For Legal Persons of Public or Private Law and Companies, if their administrative majority belongs to Greeks or EU citizens with educational and cultural objects, as set forth in their Articles of Association In case of Companies and Private Law Legal Persons, the aforementioned provisions have also to apply for their representatives, as defined by their members or administrators thereof. FOR THE SCHOOL BUILDING Provisions and Requirements for the Building The buildings to house amateur Dance School have to meet the following requirements: 1) Minimum surface of 45 sq.m. 2) Minimum height of 2.8 m. 3) Wooden beam floor 4) Area free of columns and permanently placed bars along its walls 5) Doors must open outwards and be without glasses 6) The room may be at semi-basement level, with natural lighting and ventilation. Ventilation may be attained by properly placed windows. Natural ventilation may be boosted by technical ventilation, in accordance to the areas’ volume. The room must not be humid and cold. Lighting may be boosted, at least, by technical means. 7) Minimum surface for each student: 3 sq.m. 8) A piano 9) Fire extinguishers in evident spots, placed out of reach of children, according to the provisions of the Fire Brigade. 10) Emergency exit and guiding signs. 11) Waiting area and lockers equipped, according to the number of students. 12) First Aid Kit 13) Sound insulation since necessary, according to the opinion of the competent inspection committee for building facilities. 14) Stand-by lighting in case of power supply failure. 15) Audit on the adequacy requirements of building establishments is performed by the committees set forth in Article 6, par.4, Law 1158/1981. FOR THE ART DIRECTOR (IF DIFFERENT THAN THE FOUNDER – OWNER) 1. The Studies Director of each Amateur Dance School is hired by its owner; In the case of Legal Persons of Public Law or Companies, by their Administration Board, upon approval by the competent Prefecture. 2. The Director must hold a degree or diploma by a national recognized professional dance school or a foreign recognized higher or highest Dance School and a five-year experience to a national recognized dance school or a 15-year teaching experience in a recognized school. 3. The Director of an Amateur School may take over the administration of a second School too, if they are both in the same prefecture. 4. The Director may also be the owner only if he/she has the required qualifications (degree and 5-year experience). 5. The Director may teach only if he/she is a professional teacher. FOR TEACHERS Requirements for teachers A teacher may be hired by the owner upon approval by the competent Prefecture if he/she is a holder of a teacher’s degree or diploma by one recognized dance school in Greece or by a foreign equal one. IN CASE THE APPLICANT IS A PRIVATE LAW LEGAL PERSON AND PUBLIC LAW LEGAL PERSON Requirements for Public Law Legal Persons or Private Law Legal Persons and Companies 1. For Legal Persons of Public or Private Law and Companies, if their administrative majority belongs to Greeks or EU citizens with educational and cultural objects, as set forth in their Articles of Association 2. Requirements for the founder-owner, as set forth above, have to apply for their representative who is appointed by their members or administrators. 3. For Public Law Legal Persons, only an operation permit is awarded.
Submission of an application and all required supporting documents to the competent Office of Prefectural Administration (within stipulated deadlines).
step 1: Inspection of supporting documents by the competent Authority
step 3: The Committee will audit the supporting documents and proceed to the building autopsy. Relevant minutes are drafted if all legal requirements are met.
step 2: As long as the supporting documents evidence that all legal requirements are met for the founder and director of the School to be founded, the building supporting documents are forwarded to the competent Committee.
The competent Office of the Prefectural Administration proceeds to the issuance of respective establishment and operation permit of an Amateur Dance School.
