Certified driving instructors (individuals or related enterprises) that are legally established in another EU member state may temporarily work as such in Greece.
To start-up as a driving instructor the service provider must file the following solemn statement in Greek:
“INITIAL ANNOUNCEMENT OF TEMPORARY CROSS-BORDER BUSINESS START-UP FOR CERTIFIED DRIVING INSTRUCTORS (ARTICLE 17, LAW 3844/2010)”
- (For the initial business start-up of temporary and/or occasional provision of service) “SOLEMN STATEMENT FOR INITIAL ANNOUNCEMENT OF TEMPORARY CROSS-BORDER BUSINESS START-UP FOR CERTIFIED DRIVING INSTRUCTORS (ARTICLE 17, LAW 3844/2010)”
- Information on the licenses of training vehicles to be used.
Vehicles must comply with the conditions set out in “Directive 2006/126/EC of the European Parliament and of the Council of 20 December 2006 on driving licenses” as incorporated in Greek law with JMD 43206/6028/ 2008 (GG issue No. Β΄1541), also for reasons of public safety.
- Original certificate (and translation thereof) of the competent authority of the member state where the interested party is established, stating that the individual, or the company that individual represents, is legally established in that member state, and that it legally operates, and that the natural person or the company have not, even temporarily, been prohibited to operate when the certificate was issued.
If no such certificate can be issued by a state authority of the said member state, then the following documents are produced:
•Original certificate (and translation thereof) from a competent authority of the said member state that the company in question is legally established,
•Documentation proving at least 2 years of experience as a driving instructor in the member state of establishment.
- A Greek translation of a ratified Copy of Clear Criminal Record Certificate or relevant certification from the member state where they are established.
Such Certificate should prove that the applicant has not been sentenced in that member state to any penalty for theft, embezzlement, fraud, extortion, forgery, smuggling, violation of the law for drugs, dishonesty, misconduct, moral crimes, insubordination or desertion in wartime, passive or active bribery. Especially within the last five years before filing the application they have not been sentenced for any reason whatsoever to more than 10 months imprisonment (cumulatively) or to more than 90 days imprisonment or detention (cumulatively).
Driving instructors must be legally established in another EU member state.
Step 1: Applicants shall announce the initial temporary cross-border business start-up as driving instructors to the Transport and Communications Department of the Region, and shall file all necessary documentation.
Step 3: If the 3-month deadline expires with no objection, then it is regarded that applicants can start their business. Applicants may request a relevant certificate from the competent administrative authority.
